This doctor sent another doc false medical records with my name and birthday all the way though it. But I did not have the surgery that he says that I did have done. I want a refund or do I need to seek legal help? Tammy I hired another surgeon to fix another surgeon mistake. I have now had 3 sets of implants in the last 6 years. My surgeon that I did trust did set number 1 and set number 2. Set number 2 became a mess from day one, my right one would never drop the first surgeon had a different idea on how to fix his mistake every time I would see him. The finalle straw was after I paid him $2500. to repair the right implant 5 months after getting set number 2, remember I said he always had a different idea on how to repair the problem, well when he said that he wanted to go though my nibble to open the pocket up inorder for the implant to drop, is when I fired him and went a looking for another surgeron to repair another surgeons mistake. Well come to find out, this implant never stood a chance of ever droping in to place. It was 100% not fixable at all. I either had to live looking like a freak and suffer with the pain it was causing me, or hire another well known surgeon to replace the whole 2nd set that was only 16 months old. The second surgeon requested my medical records and gave me a copy of them. Here is where the problem lies. These are my records, with my name and S.S# and my birthday all through these records. But I did not recieved the type of surgery he says I did in the surgery report. They are very detailed even down to the type of stiches he says I recieved. I did not have a transumbilical endoscope submuscular surgery for set number 2#. Well no wonder he could not figure out on how to fix them. I recieved set #2 in the crease underneath my breast. And the 3rd set has also been placed in underneath my breast in the same crease the first 2 sets where place into the breast pocket. I feel that surgeon number 1 needs to stop working on women and its time for him to retire. Surgeon #2 rocks and he was able to totaly replace the 2nd set and now my third set are so beautiful and I finally nolonger have to hide behind my clothes and I look near perfect in the breast area. Perhaps someone with the same name and date of birth? This has happened before, did they go by more information phone number match, ssn etc? If not, what exactly happened? Did you PS refuse surgery and not offer a refund? Or? Id be calling a lawyer depending on the situation in full.

you can sue a dr for malpractice if you can prove that the care he gave you was below what the standard of care is for your state. I would definitely file a complaint against him with the board and then seek some legal advice.

Hi Tammy! So sorry about the bad surgery. I have had a horrific time trying to deal with a mess from 3 surgerys one bad Dr. did on me. He botched me up so bad on the first surgery and kept saying he could fix it , and now it is a disaster! That said, can I ask who was the good surgeon that fixed you? Are you happy and is he very experienced ? My thread is "been through it all" Thanks!

I just experienced the same type of problem. My medical records never even had any information on my preoperative visits. The medical records that I did receive had things that never applied to me. It's like I was a totally different patient. Most of the documented things had no reference to me at all. The surgeon claims that he used some type of graph material on me etc,etc... How can a surgeon do the correct procedure if he or she doesn't document it for reference. I didn't see my surgeon on the day of my procedure. I found out immediately after my procedure that he did the wrong placement and used the wrong implant. I am waiting for the medical board to get back with me. It's been four months since submitting my information to them. It's possible that he will get away with it, but it will be documented when you check his status and credentials.

So sorry to hear that you have have so may problems but it's great that you are finally happy with your 3rd set!! If I were you I would make sure that it wasn't some sort of mix-up of medical records. For example, a nurse practitioner from my ob/gyn office called me a few weeks ago to congratulate me on my pregnancy.....umm but I'm not pregnant! it was a mix-up on their computers, my file was updated to reflect a pregnancy instead of their patient who actually IS pregnant. My point is that where so much is electronic these days, mistakes do happen. I would think better to confirm that's not the case before you get a lawyer involved.
